1. acceptance of terms

By downloading, installing, or using the Foresight mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Foresight is operated by Jérôme Argot, auto-entrepreneur (SIRET 813 698 438 00039), based in Lyon, France ("we," "us," or "our").

2. description of service

Foresight is an AI-powered application that generates personalized visualizations of possible future scenarios based on your inputs. The content generated by Foresight is fictional and for entertainment and inspiration purposes only. It is not financial, medical, legal, or professional advice. Foresight does not predict the future.

3. eligibility

You must be at least 16 years old to use Foresight. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent's or legal guardian's consent to use the App.

4. accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.

5. subscriptions and credits

Foresight requires a paid subscription to access its features. Subscriptions and credit purchases are processed through Apple's App Store.

• Subscriptions renew automatically at the end of each billing period (weekly or monthly) unless cancelled at least 24 hours before the end of the current period.
• Subscription credits refresh each billing cycle and do not roll over to the next period.
• Purchased credits (from one-time credit packs) do not expire.
• Cancellation: you may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: refund requests are handled by Apple in accordance with their refund policies.

6. user content and photos

You retain ownership of any photos and text you submit to Foresight. By submitting content, you grant us a limited, non-exclusive license to use it solely for the purpose of providing and improving our services (e.g., generating your personalized AI futures).

You represent that you have the right to submit all content you provide and that it does not violate any third party's rights.

7. AI-generated content

Content generated by Foresight (text, images, storylines) is created by artificial intelligence. You acknowledge that:

• AI-generated content is fictional and should not be relied upon for making life decisions.
• Generated images are artistic interpretations and may not be perfectly accurate representations.
• We do not guarantee the accuracy, completeness, or usefulness of any generated content.
• You may share AI-generated content, but you do so at your own discretion and risk.

8. prohibited uses

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Upload photos of other people without their consent.
• Attempt to reverse-engineer, decompile, or extract the source code of the App.
• Use the App to generate harmful, abusive, harassing, or misleading content.
• Circumvent any credit or subscription limitations.
• Resell or redistribute content generated by the App for commercial purposes.

9. intellectual property

The Foresight app, including its design, features, code, and branding, is the property of Jérôme Argot, auto-entrepreneur (SIRET 813 698 438 00039), based in Lyon, France and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.

10. disclaimers

Foresight is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Your use of the App is at your sole risk.

11. limitation of liability

To the fullest extent permitted by law, Jérôme Argot, auto-entrepreneur (SIRET 813 698 438 00039), based in Lyon, France shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the App, including but not limited to loss of data, loss of profits, or emotional distress. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately.

13. changes to these terms

We may modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of Foresight after changes take effect constitutes acceptance of the revised Terms.

14. governing law

These Terms shall be governed by and construed in accordance with the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lyon, France.
